REGULATIONS OF THE ONLINE STORE REGARDING CONDITIONS APPLICABLE TO MARKETERS

- 1 GENERAL PROVISIONS
The regulations define the rules and conditions for the use of services provided electronically by the Seller within the Store by marketers. In all matters not regulated by these regulations, the provisions of the Customer Regulations, available on the Store’s website, shall apply.The following definitions are established for the terms:
- CUSTOMER: A natural or legal person who places an Order in the Store.
- SUPPLIER: A natural or legal person who, under the terms specified in the relevant regulations, fulfills Orders on behalf of the Seller and delivers Products to the Customer.
- PRODUCT: A movable item presented in the Store, which is the subject of the Sales Agreement.
- SALES AGREEMENT: A sales agreement for Products concluded between the Seller and the Customer using the Store’s website.
- STORE: The website available at www.salesmonopoly.com, through which the Customer can place an Order.
- ORDER: A declaration of intent by the Customer specifying the type and quantity of Products, aimed directly at concluding a Sales Agreement.
- SELLER: SALES MONOPOLY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, headquartered at ul. Wagrowska 12G/3, 61-369 Poznań, registered in the Polish National Court Register of Entrepreneurs maintained by the District Court of Poznań — New Town and Wilda in Poznań, VIII Commercial Division of the National Court Register under the number: 0001143549, with tax identification number (NIP): 7822948680.
- MARKETER: An entity that, under the terms specified in these regulations, promotes a given product using the provided affiliate link.
- 2 MARKETER
To gain full functionality of the Store regarding the possibility of becoming a Marketer of specific Products in the Store, a natural person with the status of a sole proprietorship or a legal entity must register an appropriate Marketer account in the Store and download a personalized link to the offer of a given product.Regardless of the above, an entrepreneur obtaining the status of a Marketer is obliged to verify or complete their data upon first logging into their account in the Store.To ensure the Store’s compliance with applicable legal requirements, proper functioning, and the protection and security of its users, the Seller reserves the right to request additional data from Marketers or to verify the accuracy and validity of the data provided by them. If the verification of data or the identity of the supplier fails, the Seller may suspend or block the operation of such a Marketer’s account and, if appropriate, take other measures described in the Regulations.As part of the verification process, the Seller may request the supplier to provide, among other things:
- A scan of the current certificate of registration in the business activity register or a current excerpt from the National Court Register (KRS).
- A scan of the confirmation of registration as a taxpayer of goods and services tax (VAT) or the decision on assigning a tax identification number.
The Seller may refuse to grant access to the status of Marketer in the Store to a given entrepreneur if it is justified by the Seller’s legitimate interest, particularly in the case of:
- Actions by the Marketer or entities related to them that are contrary to generally applicable laws, the Regulations, or good practices, including conducting or advertising activities competitive to the Seller.
- Providing incomplete, false, or misleading information by the Marketer.
- Information about ongoing bankruptcy, arrangement, recovery, or liquidation proceedings of the Marketer.
- Suspension or closure of the Marketer’s business activity.
The Marketer is obliged to update their identifying data and those necessary for settlements with the Seller immediately after any changes, but no later than within 2 business days.To close the account, which is equivalent to terminating the agreement for its management, the Marketer must inform the Seller about the planned account closure via email sent to the Seller’s address. Closing the account does not affect settlements between the Marketer and the Seller.After successful registration in the Store, the Marketer is automatically included in the internal newsletter containing information from the Seller about its services. Emails sent as part of the newsletter will include information about the possibility of unsubscribing, as well as a link to do so. The Marketer may unsubscribe from the newsletter without providing a reason or incurring any costs at any time by submitting a resignation statement via the Store’s email or selecting the unsubscribe link in the email received.
- 3 PROMOTION RESTRICTIONS
The Seller grants the Marketer freedom in choosing the method of promoting a given product from its offer, i.e., the Marketer may place the link in text form or as part of a photo or video on social media platforms and other places they deem appropriate.At the same time, the Seller stipulates that it is prohibited to place a link to a given product from the Seller’s assortment in posts, entries, and other forms of communication that:
- Serve to conduct prohibited advertising, promotional, or marketing activities.
- Serve to conduct activities prohibited by law, e.g., attempts at fraud or extortion.
- Incite violence against any living beings, including animals, or glorify such violence.
- Promote any fascist or other totalitarian state system.
- Incite hatred or dangerous behavior or glorify such actions.
- Defame, insult, or otherwise violate the rights of third parties.
- Contain vulgarities or other offensive content.
- Violate the applicable legal order or good practices in any other way.
In the event of a violation of the above guidelines, the Seller reserves the right to demand the removal of such content and to take measures against such a Marketer as provided in these Regulations, including even removing the account from the Service and seeking compensation.
- 4 COMMISSION AND SETTLEMENTS
The promotional link is associated with a variable commission depending on the product, about which the Marketer is informed before downloading the link to promote the given product.When a final buyer makes a purchase after using the Marketer’s link, the Store’s IT system will assign the previously specified commission from that purchase to the Marketer’s account in the Store.The commission settlement is based on the appropriate accounting document (e.g., VAT invoice) issued by the Marketer to the Seller.
- 5 LIABILITY
The Marketer is obliged to refrain from:
- Using the Store’s functionalities directly or indirectly for purposes contrary to the law, to violate legal provisions, in a manner contrary to the Regulations, good practices, or generally accepted principles of Internet use.
- Violating the rights of the Seller or third parties, in particular by providing false data, impersonating other entities, or abusing granted privileges.
- Proposing the inclusion of Products in the Store’s assortment whose sale is prohibited.
- Failing to fulfill agreements concluded with the Seller.
- Directly or indirectly interfering with the Seller’s IT system to unauthorizedly modify data, cause dysfunctions, or overload IT systems.
The Marketer is fully responsible for the content of the information, posts, and entries they publish.
- 6 FINAL PROVISIONS
Changes to these supplier regulations will be made in the manner and within the deadlines specified in the basic Regulations.
